Tax Certainty
It is a central issue for business, with clear implications for the competitiveness of our tax system. Fiscal uncertainty (like any other kind of uncertainty) slows down investment and growth: investment is deferred, or it is invested elsewhere. Too frequent changes in tax legislation entail administrative costs (changes in procedures), risks associated with the interpretation of new rules and the likely result of litigation with the tax administration.
The legislative decrees implementing Delegation Law 23/2014 have marked important progress: the review of abuse of the law and circumvention; the reform of criminal and administrative sanctions; the revision of the appeals; the establishment of the compliance cooperative.
The Tax Laboratory has started monitoring the application of these regulatory innovations. Many of the participants have direct experience of joining the compliance cooperative. As well as the subpoena of interpelli, the management of investigations, the sending to the judicial authority of notitiae criminis for abuse of law, the management of criminal proceedings. Has anything changed in recent years? And if there has been an improvement, does it seem to have consolidated or are there signs of a decline? What suggestions can be made to improve the functioning of institutions and the relationship between taxpayers and the tax authorities? The Tax Laboratory is engaged in a discussion with the competent institutions on these issues.
